Biaura – Terms of Use

1. Introduction
These Terms of Use ("Terms") govern your use of the Biaura mobile application (the "App") and the Biaura website at biaura.app (the "Website"), collectively referred to as the "Service."
By downloading, installing, or using the Biaura App and Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Eligible Use and Accounts
The App is designed primarily for adults and older children with parental or guardian supervision.
If you are a child or teenager, you may only use the App with the knowledge and active supervision of your parent or legal guardian. Your parent or guardian is responsible for your use of the Service and agrees to these Terms on your behalf.
If you create an account or provide personal information (such as name, email, or date of birth), you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of any account credentials and for all activity under your account.
3. Wellness and Medical Disclaimer
Important: Biaura provides general relaxation, meditation, and mindfulness content only. The App and its content:
Do not provide medical, psychological, psychiatric, or other professional advice or diagnosis.
Do not treat, cure, or prevent any medical or mental health condition.
Are not a substitute for professional medical, psychological, or therapeutic care.
If you have any health concerns, mental health conditions, or are taking medications, please consult a qualified healthcare professional or therapist before using Biaura.
If at any time you experience distress, anxiety, or physical symptoms while using the App, stop immediately and seek appropriate professional help.
4. Safety and Self‑Responsibility
You are solely responsible for how and when you use Biaura. By using the Service, you acknowledge that:
You will not use the App while driving, operating machinery, or in any situation where full attention is required, especially if using guided meditations or visual journeys that may induce deep relaxation or drowsiness.
You will pause or exit the App if you feel unwell, uncomfortable, or distressed.
You listen to your own body and nervous system and will adjust your use accordingly.
If you use the App as a child or teenager, your parent or guardian accepts full responsibility for your use and any outcomes.
5. Subscriptions, Payments, and Cancellations
Biaura offers both free and premium content. Premium content requires a paid subscription through your Apple ID.
Pricing and Billing:
Subscription pricing, billing cycles (monthly and/or yearly), and any trial or promotional offers are set by Biaura and displayed before you make a purchase.
All payments are processed securely through the Apple App Store. Biaura does not directly process or store your payment card details.
Your subscription will automatically renew at the end of each billing period unless you cancel it.
Managing and Cancelling Your Subscription:
You can manage or cancel your subscription at any time through your Apple ID settings on your device or at appleid.apple.com.
Cancellation takes effect at the end of your current billing period; you will retain access to premium content until that date.
Biaura does not process refunds directly. Refund requests must be made through the Apple App Store according to their refund policy.
No Refunds from Biaura:
Payments are final and non‑refundable through Biaura. Any refunds are issued by Apple according to their policies and terms.
6. Intellectual Property
All content in the Biaura App and Website—including but not limited to audio recordings, music, visual content, photography, text, graphics, code, and the Biaura brand and logo—is owned by Bianca Heiss and/or licensed from third-party creators. All content is protected by copyright and international intellectual property laws.
Your Licence:
You are granted a personal, non‑exclusive, non‑transferable, revocable licence to use the Service and its content for your personal, non‑commercial use only.
You may not:
Copy, download, record, or reproduce any meditations, music, visuals, or content without explicit written permission.
Redistribute, resell, or share content with others or on any platform.
Reverse engineer, decompile, or attempt to derive the source code or underlying technology of the App.
Use content for any commercial purpose.
Violation of these restrictions may result in termination of your access to the Service and legal action.
7. Acceptable Use
You agree not to use the Service to:
Harass, threaten, defame, or abuse others.
Upload, transmit, or share illegal, harmful, obscene, or otherwise objectionable content.
Attempt to gain unauthorised access to the App, servers, or networks.
Introduce malware, viruses, or other harmful code.
Interfere with the proper functioning of the Service or other users' experience.
Violate any applicable laws or regulations.
Biaura reserves the right to suspend or terminate your access if you violate these terms.
8. Limitation of Liability
To the extent permitted by applicable law:
Biaura is provided "as is" without warranties of any kind, express or implied. Biaura does not warrant that the Service will be uninterrupted, error‑free, or secure.
Biaura shall not be liable for:
Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
Loss of data, business interruption, or lost profits.
Issues arising from device problems, network failures, or third‑party services.
Any harm, distress, or outcomes resulting from your use of the meditations or content, including but not limited to physical, psychological, or emotional harm.
Your sole remedy for any dissatisfaction with the Service is to discontinue use.

9. Changes to the App, Content, and Terms
Biaura reserves the right to:
Update, modify, or discontinue any feature, content, or functionality of the App at any time.
Change pricing or subscription terms, with reasonable notice provided in‑app or via email.
Update these Terms at any time.
When we update these Terms, we will change the "Last updated" date at the top. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
10. Termination
Biaura may terminate or suspend your access to the Service immediately and without notice if you violate these Terms or engage in harmful, illegal, or disruptive behaviour. Upon termination, your right to use the Service ceases, though you may retain access to any free content you have already downloaded, subject to these Terms.

12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles.
